2. Purpose of the Website

The purpose of the Website is to provide information about the products, services and activities developed by GOBER ARTIFICIAL INTELLIGENCE, S.L. (hereinafter, "Gober"), as well as to facilitate contact between the company and its potential clients, collaborators, suppliers, candidates for recruitment processes and any other interested third parties.

Access to the Website is free of charge and does not require prior registration, except for those functionalities in which the User expressly requests certain services or content.

3. Conditions of use of the Website

Access to and use of the Website confers the status of User and implies the full and unreserved acceptance, from such access and/or use, of all the provisions included in this Legal Notice, as well as in the Privacy Policy and the Cookie Policy. Users who do not agree with any of the terms set out herein must refrain from using the Website.

The User undertakes to make appropriate use of the contents and services of the Website in accordance with the Law, public morals, public order, customary commercial practice and this Legal Notice. In particular, the User undertakes:

  • Not to infringe the intellectual or industrial property rights owned by Gober or third parties.
  • Not to engage in acts of unfair competition or misleading or unlawful advertising.
  • Not to impersonate any other User, individual or legal entity, nor use false or third-party credentials.

Gober reserves the right to deny or withdraw access to the Website at any time and without prior notice to those Users who fail to comply with these conditions or the applicable provisions.

4. Intellectual and industrial property

All contents of the Website, including by way of example texts, photographs, graphics, images, icons, technology, software, source code, links, videos, audiovisual or sound content, as well as their graphic design, structure, selection, arrangement and presentation, are the intellectual property of Gober or, where applicable, of third parties that have authorised their use. None of the exploitation rights recognised by the applicable intellectual property legislation may be deemed transferred to the User.

The trademarks, trade names, distinctive signs, logos, designations of origin and, in general, any signs capable of use in commerce owned by Gober (including, without limitation, "Gober", "Gober.ai" and any variants) are protected by applicable national and international legislation, and their unauthorised use may give rise to the exercise of the corresponding legal actions.

Total or partial reproduction, distribution, public communication, transformation or any other form of exploitation of the contents of the Website is prohibited, by any means and in any format, without the prior, express and written authorisation of Gober or, where applicable, the rights holder. Any use not expressly authorised will be considered an infringement of intellectual or industrial property rights.

5. Exclusion and limitation of liability

Gober makes its best efforts to ensure the availability, accuracy, truthfulness, currency and updating of the contents of the Website. However, to the maximum extent permitted by applicable law, Gober shall not be liable for:

  • Errors, omissions, inaccuracies or lack of updating of the contents published on the Website.
  • Interruptions, suspensions, technical failures, cyberattacks, viruses or any other harmful elements affecting the functioning of the Website, its services or the User's equipment.
  • Direct or indirect damages or losses arising from the use of the Website or from reliance placed on its information.

The User assumes, under their sole responsibility, the consequences, damages or actions that may arise from access to the contents of the Website, as well as from their reproduction or dissemination.

Gober assumes no responsibility for the contents, services, products, privacy policy or processing of personal data that may be offered through such third-party websites.

The inclusion of these links does not imply any relationship, recommendation, association, merger, participation, collaboration or supervision by Gober regarding the linked websites. The User is fully aware and accepts that access to such websites is carried out under their own responsibility.

The processing of personal data that the User provides to Gober through the Website is governed by the provisions of the Privacy Policy and, in relation to the use of cookies and similar technologies, by the Cookie Policy, both accessible from the Website. By using the Website, the User declares to have read and understood the content of both policies.

8. Modifications to the Legal Notice

Gober reserves the right to modify this Legal Notice at any time and without prior notice, as well as any other general or particular condition of the Website. Modifications will take effect upon publication on the Website. Users are advised to periodically review this Legal Notice.

9. Partial invalidity

If any clause included in this Legal Notice is declared, totally or partially, null or ineffective by a competent authority, such nullity or ineffectiveness will not affect the remaining provisions, which will retain their full validity and effectiveness, and will be replaced by those that, in accordance with the applicable regulations, pursue the same purpose.

10. Applicable law and jurisdiction

This Legal Notice and any relationships established between the User and Gober in connection with access to the Website shall be governed by Spanish law.

For the resolution of any controversy that may arise from access to or use of the Website, the parties, with express waiver of any other jurisdiction that may correspond to them, submit to the exclusive jurisdiction and competence of the Courts of Vigo (Pontevedra), unless applicable regulations establish a different mandatory jurisdiction (in particular, where the User holds consumer status, in which case the jurisdiction of the consumer's domicile will apply).
